Please read these Terms of Service ("Terms") carefully before using the Trustart Technologies Limited website and services. This is a legally binding agreement.
By accessing or using our services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to all of these terms, do not use our services. We may modify these Terms at any time, and such modifications shall be effective immediately upon posting.
You must be at least 18 years old and of the legal age of majority in your jurisdiction to use our services. You represent and warrant that you are not located in, under the control of, or a national or resident of any restricted locations. This service is intended for Canadian residents.
Trustart Technologies Limited provides a platform for exchanging Canadian Dollars (CAD) for various digital currencies ("Cryptocurrency"). We are registered with the Financial Transactions and Reports Analysis Centre of Canada (FINTRAC) as a Money Services Business (MSB). All transactions are subject to regulatory review.
You agree to provide accurate, current, and complete information as required for the transaction and identity verification processes. You are responsible for maintaining the security of your wallet addresses and are solely responsible for any and all activities that occur under your transaction request. You agree not to use our services for any illegal activities.
As a regulated MSB, we are required to comply with Anti-Money Laundering (AML) and Know Your Customer (KYC) regulations. This means we must:
By using our service, you agree to cooperate with all requests for information and documentation necessary to meet these regulatory requirements.
All applicable fees will be disclosed to you prior to confirming a transaction. Once a transaction is initiated and broadcast to the relevant Cryptocurrency network, it cannot be canceled or reversed. We are not responsible for losses incurred due to user error, such as providing an incorrect wallet address.
You acknowledge and agree that there are significant risks associated with buying, selling, and trading Cryptocurrencies. The value of digital assets is highly volatile and can change dramatically in a short period. You should carefully consider whether trading Cryptocurrency is suitable for you in light of your financial condition.
To the fullest extent permitted by law, Trustart Technologies Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to, loss of profits, data, or other intangible losses, resulting from your access to or use of, or inability to access or use, the service.
We reserve the right to suspend or terminate your access to our services at our sole discretion, without prior notice, for any reason whatsoever, including without limitation if you breach the Terms. This is particularly relevant if a transaction is flagged for suspicious activity under FINTRAC guidelines.
These Terms shall be governed and construed in accordance with the laws of the province of Quebec and the federal laws of Canada applicable therein, without regard to its conflict of law provisions. Any disputes will be resolved in the courts of Montreal, Quebec.
